Terms and conditions

The following terms and conditions apply to your use of the Powermac Products Pty. Ltd web site (“the web site”) & all general trading with Powermac Products Pty. Ltd(ABN 98 050 982 842 / ABN: 98 050 982 842) including through, but not limited to this web site.

By using this site, making transactions, and purchasing from Powermac Products Pty. Ltd in any way shape or form, you are are bound by these Terms & Conditions.

Powermac Products Pty. Ltd will not be held liable for Fraudulent Transactions as outlined in Clause 16.

These terms and conditions are subject to change by Powermac Products Pty. Ltd Powermac Products Pty. Ltd may change the content of its terms and conditions at any time without prior notice to anyone.

1. Quotation/pricing
Any Quotation made by Powermac Products Pty. Ltd is not an offer to sell, and no order given in pursuance of any Quotation shall bind the customer unless accepted by them. Unless agreed in writing, all orders are subject to acceptance by Powermac Products Pty. Ltd within seven (7) days of receipt by Powermac Products Pty. Ltd of the customer’s offer.
All pricing in Australian dollars and inclusive of GST (Goods and Services Tax). Please note that pricing and stock availability are subject to change without prior notice. E&OE.
Unless otherwise stated Quotations are only valid for seven (7) days.

2. Delivery
Powermac Products Pty. Ltd will arrange physical delivery of products to the Customer’s address, such delivering being at the cost of the Customer as calculated at the completion of the order.
If no one is present at time of delivery, Powermac Products Pty. Ltd reserves the authority to leave goods at delivery address at clients risk.

3. Delivery time
Any date Quoted for delivery is an estimate only, and unless a guarantee shall have been given by Powermac Products Pty. Ltd in writing providing for liquidated damages for failure to deliver by the Quoted date, Powermac Products Pty. Ltd shall not be liable to the Customer for any loss or damage howsoever arising for failure to deliver on or before the Quoted date. The Customer shall accept and pay for Products, not withstanding any failure by Powermac Products Pty. Ltd to deliver by the Quoted date.

Goods must be fully paid prior to delivery and cannot be returned or exchanged without express approval from Powermac Products Pty. Ltd in writing. The latter case would still attract the normal restocking fee.

4. Warranty Returns
In the event that normal stock lines, advertised in the Powermac Products Pty. Ltd price list are to be returned, a 20% restocking charge applies. Goods must be in original saleable condition and a copy of invoice attached.

This applies within 14 days of delivery and at the sole discretion of Powermac Products Pty. Ltd an “RA” number and approval must be received before sending the goods and this must appear on returned goods and documentation, such as consignment notes.

Please obtain an “RA” number from Powermac Products Pty. Ltd and clearly mark goods with same, attaching copy of original purchase invoice. Powermac Products Pty. Ltd warranty and serial number labels must be clearly attached, as their removal voids warranty. Any unauthorised repair or upgrade voids warranty. Unless a unit is dead on arrival or damaged in transit, in this case it must be received within 7 days of invoice date, goods remain the property of the customer and will be processed by the relevant manufacturer or agent as soon as possible. Powermac Products Pty. Ltd will not be liable for any loss, whether material or not of such goods.

5. RETURNS

A) For REPAIR/REPLACEMENT

1. No replacement will be sent out before we receive and test any goods suspected to be faulty.
2. Goods found to be faulty can be returned for repair/replacement within the applicable warranty period.
3. Warranties commence from the date of Powermac Products Pty. Ltd sale.
4. Freight policy – You pay freight to Powermac Products Pty. Ltd, Powermac Products Pty. Ltd pays return freight after repair/replacement.
5. Goods being returned under warranty MUST include;
a. Return Authorisation number (To download the applicable form click here)
b. Adequate fault description.
c. Suitable packaging – Powermac Products Pty. Ltd will NOT warrant damaged goods.

B) FOR CREDIT
1. Credits can be issued for goods falling under the following categories:
a. Powermac Products Pty. Ltd shipped the wrong product
b. The product is Dead on Arrival (DOA) – i.e. found to be faulty within seven (7) days of Powermac Products Pty. Ltd invoice date.
c. Damages or short shipments (must be reported to Powermac Products Pty. Ltd within 48 hours).
2. Goods not falling under the above categories can be returned for credit (subject to management approval) AND will be subject to a 20% restocking fee under the following scenarios:
a. You cancelled order
b. You ordered wrong product
c. Goods returned more than seven (7) days after Powermac Products Pty. Ltd invoice date (where approved by management).
d. Goods are returned more than five (5) days after receipt of Credit Authorization number.

4. Credits will not be accepted by Powermac Products Pty. Ltd;
a. Where goods are not in original condition AND packaging (including all applicable manuals, cables and drivers, etc)
b. Where an authorization number (on the applicable form) is not included with the delivery.
c. Where the goods in question are not returned to Powermac Products Pty. Ltd within 5 days of the authorization number being issued
d. Where goods are damaged
e. Where goods are sent back for credit because they are faulty, and no fault is found by Powermac Products Pty. Ltd
5. Powermac Products Pty. Ltd pays the freight for credits ONLY where the return is a direct result of a Powermac Products Pty. Ltd error or omission or where goods are found to be faulty within 7 days of Powermac Products Pty. Ltd invoice.
6. Where Powermac Products Pty. Ltd agrees to pay the freight, a pick up will be arranged from your premises by Powermac Products Pty. Ltd UNDER NO CIRCUMSTANCES WILL Powermac Products Pty. Ltd ACCEPT FREIGHT FORWARD DELIVERIES.

6. Refunds/cancellations
If requested by Powermac Products Pty. Ltd, the Customer may be required to provide information that can easily assist Powermac Products Pty. Ltd with any monetary refund or cancellation. This information may include customer’s names, address, home phone, work phone, credit card details and other relevant information required by Powermac Products Pty. Ltd Failure to provide sufficient information may delay the refund or cancellation, Powermac Products Pty. Ltd is not to be held responsible for any delays according to clause 7 provided by Powermac Products Pty. Ltd

7. Product Information, advertising and links to third party websites
a. This website contains information on goods and services which the Customer may purchase including inter alia product descriptions and specifications. With the exception of information relating to Powermac Products Pty. Ltd pricing and stock availability, all product information has been provided by the relevant original equipment manufacturer and/or vendor and not Powermac Products Pty. Ltd, and Powermac Products Pty. Ltd has included it on this Website as a convenience only. The customer should confirm all product descriptions and specifications with the relevant original equipment manufacturer or vendor before purchase.

b. This Website contains hyperlinks and pointers to other websites operated by third parties. These linked websites are not controlled by Powermac Products Pty. Ltd, and Powermac Products Pty. Ltd is not responsible for the contents of any linked website or any hyperlink contained in a linked website. The hyperlinks are provided as a convenience only, and the inclusion of any hyperlink on this Website does not imply any endorsement of the linked website by Powermac Products Pty. Ltd The customer links to any such website entirely at its own risk.

c. This Website also contains third party advertisements (including banner ads, partial and full page advertisements) which may contain embedded hyperlinks or which include referral buttons to websites operated by third parties or their licensees or contractors. All third party advertising (including referral buttons and embedded hyperlinks) is paid by for the relevant third party advertisers and must not be construed as either recommendations or endorsements by Powermac Products Pty. Ltd The customer is referred to the relevant advertiser for all information regarding the advertiser and its products and/or services.

d. In some instances, the advertisement may contain representations or offers by the third party advertiser which the Customer may accept by linking to the advertiser’s website and executing the relevant transaction. Such offers are made by the third party advertisers and not Powermac Products Pty. Ltd, and the third party advertisers are solely responsible to the Customer for the delivery of any goods or services the Customer purchases on the third party websites.

8. Payment
Unless otherwise agreed in writing, payment for products supplied shall be made in full by the Customer to Powermac Products Pty. Ltd prior to shipping.

9. Liability
Powermac Products Pty. Ltd shall not be liable to the Customer, or to any other person whomsoever, for any loss or damage whatsoever or howsoever caused arising directly or directly in connection with the Products, other that expressly imposed by statute in terms of which it is not possible to limit or exclude liability.

Powermac Products Pty. Ltd expressly excludes liability for consequential loss or damage including but not limited to loss of profit, business, revenue, goodwill or anticipated savings.

10. Default in Payment
If the Customer defaults in payment to Powermac Products Pty. Ltd, then:
a/ the Customer shall pay to Powermac Products Pty. Ltd, on demand, interest on any overdue money during the period of default at the rate for the time being fixed under Section 2 of the Penalty Interest Rates Act 1983, and
b/ all moneys owing by the Customer to Powermac Products Pty. Ltd shall become due and payable forthwith without demand, and
c/ Powermac Products Pty. Ltd may at its sole and absolute discretion suspend the provision of credit to the Customer until all amounts owing by the Customer are paid in full

11. Retention of Title
11.1 The title to the products will pass to the Customer when payment in full for the Products has been received by Powermac Products Pty. Ltd

12. Differences and Complaints
Subject to the provisions of clause 10, Powermac Products Pty. Ltd shall not be liable in respect of any difference or complaint arising out of the terms and conditions of sale unless the Customer advises Powermac Products Pty. Ltd in writing of the difference or complaints not later than fourteen (14) days after the date of the occurrence of the events or circumstances on which the difference of complaint is based.

13. Severability
In the event that any part of these terms and conditions shall be deemed invalid, unlawful or un-enforceable to any extent, such terms or conditions shall be severed from the remaining terms and conditions, which shall continue to be valid and enforceable to the fullest extent permitted by law.

14. Free Freight
Free freight is valid for single orders over the value of $550 AUD Including GST, within Australia. Orders made from outside Australia and from Overseas are not eligible for free freight.

Orders within the Metropolitan area of Adelaide as defined by Powermac Products Pty. Ltd over $110 Inc GST will be delivered for free.

15. 24 Hour Delivery
As per advertising on SAFM, 24 Hour Delivery is only possible if product(s) are in stock. Applicable to Adelaide Metro Area only.

16. Fraudulent Transactions
Powermac Products Pty. Ltd will not be held liable for Fraudulent Transactions made through this website.
If such transactions occur then the offender(s) will be referred to the relevant authorities and will be prosecuted to the full extent by law.

Powermac Products Pty. Ltd take every step to eliminate Fraudulent transactions and if a transaction is suspicious then the goods will not be sent until the owner of the Credit Card can be verified & verification of the customer's identity and address is also verified.

In the event that a Credit Card holder is a victim of such transaction(s) Powermac Products Pty. Ltd as a merchant will work with the banks to resolve the dispute as quickly as possible.

Powermac Products Pty. Ltd is happy to co-operate with Financial Institutions and consumers who are victims of Fraudulent Transactions, to refund the transaction after the requests of the bank are satisfied.
We ask for co-operation from all persons involved to resolve the situation as quickly as possible.


17. Non e-Commerce Credit card orders
Any order made to be paid by credit card in the form of credit card details via e-mail, phone or fax must be accompanied by a copy of the card (front and back)and the cardholders full details including telephone number and address.



19. Governing Law
Powermac Products Pty. Ltd and the Customer agree that the terms and conditions of sale shall be governed by the laws of the Victoria.
